The HFEA responds to the CMA's report on fertility clinics’ compliance with consumer law

The HFEA has responded to the Competition and Markets Authority’s report on fertility clinics’ compliance with consumer law.

Rachel Cutting, Director of Compliance at the HFEA, said:

“The HFEA welcomes the work from both the Competition and Markets Authority and the Advertising Standards Authority in areas that lie outside the HFEA’s powers, but that will make a real difference for patients through supporting positive clinic compliance.

“Both regulators have recognised that making decisions about fertility treatment – where most patients are paying for it themselves – can be expensive and difficult, as well as emotionally and physically draining. Complying with consumer law makes it easier for patients to compare fertility clinics and make an informed choice based on accurate information.

“The reports note the improvements made over the last year. We urge all clinics to continue to look at the CMA guidance and the ASA enforcement notice to ensure they set out clear information to patients.

“We will carefully consider the recommendations, especially those around encouraging licensed clinics to join an alternative dispute resolution scheme.

“The HFEA is currently looking at what changes we would like to make to our law – which is over 30 years old – to make it relevant for the modern fertility sector. We look forward to the CMA’s response to our forthcoming consultation on legislative reform.”
